Wife Sues Husband To Court Over Fraud

Isah Mary, a housewife, has sued her husband, Babalola Adegoke, in an Ekiti State High Court in Ado Ekiti for defrauding her of N3.150 million.

Isah said she submitted and received her late father’s entitlement in 2015, after he resigned as a senior police officer and died the same year. Because she was her father’s next of kin, a payment of almost $5 million was transferred into her account. Her spouse, on the other hand, collected a sum of N3.150 million under dubious circumstances and transferred it to his personal use.

The charge read:

“That Babalola Adegoke on 4th & 16th February, 2021 at Iye Ekiti in Ilejemeje Local Government Area of Ekiti State did obtain and steal the sum of N3.150m from one Isah Mary contrary to Section 419(2) and 390(9) of the Criminal Code Law, Cap. C7, Laws of Ekiti State, 2012.”

Barrister Kolapo Kolade, the prosecution, called two witnesses, and proofs included notional complainant’s statements of account, police minute sheets, and cash sales invoices, among others.

Adegoke refuted the claims leveled against him by the accuser, claiming that he was financially responsible for the defendant and their two children both before and after her father’s death. During his defense, he summoned three witnesses.

Justice Lekan Ogunmoye, who delivered the verdict, acquitted and released the accused based on the defendant’s inability to establish her case against him.

He said:

‘’I am unable to hold that the prosecution has proved the charge of obtaining money under false pretense from the claimant.

“In all, the sole issue for determination is resolved against the prosecution. I hold that the prosecution had not proved its case against the defendant beyond reasonable doubt. He is discharged and acquitted on both counts.”
